Refund policy of ShapeShock
1. Introduction
This refund policy applies to all services and products offered by ShapeShock. By using our services or products, you agree to this policy.
2. Definitions
- Customer: Any natural or legal person using ShapeShock's services or products.
- Agreement: Any agreement between ShapeShock and the Customer regarding the provision of services or products.
3. Result guarantee and reimbursement
3.1 Result guarantee
ShapeShock aims for a reduction of 2 to 8 cm in total girth after a treatment. If this result is not achieved, the Customer is entitled to a full refund within 30 days of the treatment. This guarantee is one-time per Customer and applies to the first treatment only.
3.2 Conditions for Reimbursement
To be eligible for the refund under the result guarantee, the Customer must meet the following conditions:
- Preliminary Measurements: Before treatment begins, accurate measurements are taken by an authorised ShapeShock staff member to determine the Customer's initial measurements.
- Aftercare and instructions: The Customer should strictly follow all aftercare instructions provided by ShapeShock. Failure to comply with these instructions may affect the result achieved and may result in the result guarantee being voided.
- Timely Refund Application: The Customer should submit a written request for refund to ShapeShock within 30 days of the treatment, accompanied by all relevant documentation and supporting documents.
4. Exceptions to the Outcome Guarantee
ShapeShock reserves the right to refuse the outcome guarantee in the following cases:
- Medical Conditions: If the Customer suffers from medical conditions that may affect the result achieved and has not reported them to ShapeShock prior to the treatment.
- Non-compliance with Instructions: If the Customer has not followed the aftercare instructions provided.
- Repeated Treatments: The result guarantee applies to the first treatment only. For follow-up treatments, this guarantee does not apply.
5. Refund procedure
If the Customer meets the conditions for refund, ShapeShock will refund the full amount of the treatment within 14 days of receiving the written request. The refund will be made via the same payment method used by the Customer for the original payment.
6. Limitation of Liability
ShapeShock is not liable for indirect damage, consequential damage or lost profits as a result of not achieving the desired result. ShapeShock's liability is at all times limited to the amount paid for the treatment in question.
7. Applicable law and disputes
This refund policy is governed by Belgian law. Disputes arising from or related to this policy will be submitted to the competent court in the district where ShapeShock is located.
